 Pursuant to the Law on Local Government Organization dated June 19, 2015;

Pursuant to the Law amending and supplementing certain articles of the Law on Local Government Organization dated November 22, 2019;

Pursuant to Circular No. 01/2010/TT-BVHTTDL dated February 26, 2010, of the Ministry of Culture, Sports, and Tourism on promulgating regulations on the organization and operation of public service units in the fields of culture, sports, and tourism at districts, towns, provincial cities, and centrally managed cities;

Pursuant to the Inter-ministerial Circular No. 17/2010/TTLT-BTTTT-BNV providing guidance on implementing the functions, tasks, powers, and organizational structure of provincial Radio and Television Stations under the People’s Committee, and District Radio Broadcasting Centers under District People’s Committees;

Pursuant to Decision No. 11/2014/QĐ-UBND dated April 21, 2014, and Decision No. 15/2015/QĐ-UBND dated May 5, 2015, of the People’s Committee of Phu Yen Province on regulations regarding decentralization of management of organizational structure, staffing, payrolls, salaries for officials, civil servants, public employees, and leadership positions in state-owned enterprises under the People’s Committee of Phu Yen Province;

Pursuant to Decision No. 374/QĐ-UBND dated March 15, 2019, of the People’s Committee of Phu Yen Province on the establishment of the Tay Hoa District Center for Culture and Broadcasting;

Pursuant to Decision No. 734/QĐ-UBND dated April 2, 2024, of the District People’s Committee on the approval of job positions and the professional title structure of public employees at the Tay Hoa District Center for Culture and Broadcasting;

Pursuant to Notification No. 325/TB-UBND dated October 9, 2024, of the District People’s Committee on the conclusion of the District People’s Committee during the meeting held on the afternoon of October 7, 2024;

At the request of the Director of the Tay Hoa District Center for Culture and Broadcasting as per Proposal No. 26/TTr-TTVHTT dated August 26, 2024,

DECISION:

Article 1. Issued together with this Decision Regulating the functions, tasks, powers and organizational structure of the Department of Culture and Information of Tay Hoa district.

Article 2. This Decision takes effect from the date of singning.

 Article 3. The Chief of the Office of the People’s Council and People’s Committee, Head of the Department of Home Affairs, Director of the Tay Hoa District Center for Culture and Broadcasting, and the Heads of relevant agencies and units are responsible for the implementation of this Decision./.

RULE DEFINITION

Functions, tasks, powers and organizational structure

of the Department of Culture and Information of Tay Hoa district

(Issued together with Decision No. 2838/QD-UBND dated October 25, 2024 of Tay Hoa District People’s Committee)

Chapter I
POSITION, FUNCTIONS, TASKS, AND POWERS

Article 1. Position and Functions

  1. The District Center for Culture and Broadcasting is a public service unit under the People’s Committee of Tay Hoa District. It advises the District People’s Committee on developing cultural, sports, broadcasting, and tourism activities; directly manages and operates the district’s official electronic information portal; organizes propaganda activities to disseminate the Party’s guidelines and policies, the State’s laws, and implements local political, economic, cultural, and social tasks. The center organizes and provides public services to meet the cultural, artistic, physical training, sports, information, and tourism needs of the community. It fulfills the community’s demand for information, education, creativity, and cultural enjoyment, serving as the propaganda organ of the district’s Party Committee and government.
  2. The District Center for Culture and Broadcasting has legal status, its own seal, and a separate account. It operates under the direct direction and management of the District People’s Committee within its jurisdiction. At the same time, it is subject to the professional guidance, inspection, supervision, and support of the Department of Information and Communications, the Department of Culture, Sports and Tourism, and the Phu Yen Provincial Radio and Television Station.

Article 2. Tasks and Powers

1. In the field of Culture, Sports, and Tourism

a) Based on the district’s socio-economic development programs and annual work plans, the District Center for Culture and Broadcasting shall proactively develop plans and implement them upon approval by the District People’s Committee.

b) Organize cultural and artistic activities, propaganda campaigns, reading sessions, recreational activities, film screenings, clubs, hobby groups, and art talent classes.

c) Organize district-level sports activities and participate in provincial-level events; provide technical guidance, methods, and conditions for training for organizations and individuals.

d) Organize festivals, competitions, performances, sports tournaments, and guide cultural, artistic, and sports movements at the grassroots level.

e) Identify and nurture talent in culture, arts, and sports.

f) Collect, preserve, and guide traditional folk art forms and sports.

g) Organize specialized professional activities, cultural, and sports services, and other services to meet the needs of the people in the district in compliance with the law and the center’s infrastructure.

h) Cooperate, exchange expertise, and engage in activities in culture, sports, and tourism with organizations inside and outside the province.

i) Advise on promoting tourism development.

j) Manage staff, employees, finances, and assets in accordance with the law.

2. In the field of Broadcasting

a) Produce and broadcast radio programs in Vietnamese via loudspeaker systems and equipped broadcasting devices to disseminate the Party’s policies, the State’s laws, local government directives, community activities, technical and scientific knowledge, economic, cultural, and social matters, security and order, and highlight exemplary individuals and practices, in accordance with the law.

b) Relay and broadcast programs from the Voice of Vietnam and the Phu Yen Provincial Radio and Television Station to meet public information needs, in accordance with the law.

c) Directly manage and operate technical systems for relaying and broadcasting radio programs, as prescribed by law.

d) Manage and operate broadcasting stations in the area as assigned; provide technical and professional guidance to commune- and town-level radio stations within the district.

e) Manage and utilize labor, assets, budgets, and revenue from services; implement policies for staff and employees under its management, in accordance with the law.

f) Prepare periodic and ad-hoc reports as required by higher management authorities; participate in professional activities organized by superior agencies; conduct reward and competition activities in compliance with the law.

g) Provide opinions to the District People’s Committee and relevant authorities to strengthen and expand broadcasting services in the area.

h) Provide services related to broadcasting.

3. In the field of the District People’s Committee’s Electronic Information Portal

– Develop plans in collaboration with the Department of Information and Communications to maintain, operate, and upgrade the interface of the district’s electronic information portal to ensure vibrancy and meet the information needs of organizations and individuals, as well as provide public services in compliance with the law.

– Perform content administration; edit, update, and publish news articles and images reflecting the district’s activities on the electronic information portal of the District People’s Committee.

– Publish documents to support the directive and administrative tasks of the District People’s Committee and district agencies and units.

4. Perform other tasks and exercise powers assigned by the District People’s Committee and its Chairman, in accordance with the law.

Chapter II
ORGANIZATIONAL STRUCTURE AND STAFFING

Article 3. Organizational Structure

The District Center for Culture and Broadcasting has one (01) Director, no more than two (02) Deputy Directors, and professional departments as follows

a) Administration – General Affairs

b) Culture – Arts

c) Sports and Tourism

d) Broadcasting – Propaganda

2. The Director and Deputy Directors are appointed, dismissed, relieved of duties, rewarded, disciplined, transferred, or rotated by the Chairman of the District People’s Committee, and are subject to other policies and regulations as prescribed by law and according to the management decentralization.

Article 4. Staffing

  1. The staffing levels of the District Center for Culture and Broadcasting are determined by the Chairman of the District People’s Committee based on the Center’s functions, tasks, and job positions.
  2. Based on the functions, tasks, and job positions approved by competent authorities, the District Center for Culture and Broadcasting shall annually prepare a staffing plan to ensure the fulfillment of assigned tasks and submit it to the competent authorities for approval in accordance with regulations.

ORGANISATIONAL STRUCTURE

Regarding the investment in machinery and broadcasting equipment in the district during the process of constructing and developing the district’s broadcasting career:

  1. For the People’s Committee of Tây Hòa District

The District Culture and Broadcasting Center is directly and comprehensively led and directed by the District People’s Committee, adhering to the reporting regime as prescribed. The Center advises and proposes to the District People’s Committee on matters related to its functions and duties.

  1. For the departments, divisions, unions, and People’s Committees of communes and towns

The Center coordinates with the district-level departments, divisions, unions, and the People’s Committees of communes and towns based on the principle of shared responsibility and mutual support to accomplish the district’s overall political tasks, following the working regulations of the District People’s Committee and relevant regulations.

Chapter IV: FINANCE AND ASSETS

Article 7: Financial regime

The District Culture and Broadcasting Center is a public service unit under the District People’s Committee, responsible for developing and submitting self-reliance plans for approval by the District People’s Committee, in compliance with the regulations and timelines set by the Provincial People’s Committee.

Prepare budgets and manage revenues and expenditures as per the law.

Develop service fee schedules and submit them to the District People’s Committee for approval.

Article 8: Responsibilities for asset management and use

The District Culture and Broadcasting Center is responsible for managing state assets as stipulated by law on the management and use of state assets in public service units.

Chapter V: IMPLEMENTATION ORGANIZATION

Article 9: The Center’s Director is responsible for organizing the implementation of this Regulation among all officials and employees in the unit.

Article 10: During implementation, if there are changes, supplements to functions, duties, powers, or organizational structure in higher legal documents, or if challenges arise, the Center’s Director shall coordinate with the heads of relevant agencies and units to report to the District People’s Committee for consideration and adjustment as appropriate./.
